These Terms and Conditions ("Terms") govern your use of Aquascape Oasis' aquascaping services, including but not limited to aquarium installation, maintenance, emergency services, and consultations.
By scheduling a consultation, signing a service agreement, or engaging our services in any capacity, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations.
If you do not agree with any of these terms, please do not use our services. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting on our website.
Installation Services: Custom aquascaping design, equipment setup, livestock introduction, and ecosystem establishment for residential and commercial clients.
Maintenance Plans: Recurring service visits including Basic Care, Premium Care, Elite Care, and Golden Care packages as described on our services page.
Emergency Services: On-demand emergency response for aquarium crises, equipment failures, water quality issues, and livestock emergencies.
Consultations: Professional assessment, design planning, and advisory services for aquascaping projects of all scales.
Installation Projects: 50% deposit required upon contract signing, with remaining balance due upon project completion. Payment is due within 30 days of invoice date.
Maintenance Plans: Recurring services are billed in advance. Annual plans receive a discount. Auto-renewal applies unless cancelled with 30 days written notice.
Emergency Services: Payment due within 15 days of service completion. Emergency service rates start at $500 per visit and vary based on complexity and urgency.
Late Payments: A 1.5% monthly service charge will be applied to overdue accounts. Services may be suspended for accounts more than 60 days past due.
Accepted Payment Methods: Cash, check, credit card, bank transfer, and approved financing options.
Access Requirements: Client must provide safe, reasonable access to aquarium location during scheduled service times. Any access restrictions must be communicated in advance.
Service Standards: We maintain professional standards and use industry-best practices. All work is performed by trained technicians using appropriate equipment and materials.
Scheduling: Service appointments are scheduled at mutual convenience. 24-hour notice required for appointment changes. Emergency services are subject to availability.
Property Protection: We take reasonable precautions to protect your property during service. Client should secure or remove valuable items from work area.
Service Satisfaction: We guarantee 100% satisfaction with our services. If unsatisfied within 30 days of completion, we will remedy the issue at no additional cost.
Equipment Warranty: All equipment installed carries manufacturer warranty. We provide 90-day warranty on installation workmanship and 30-day warranty on livestock health.
Natural Ecosystem: Due to the living nature of aquatic ecosystems, we cannot guarantee specific growth patterns, coloration, or behavior of plants and livestock beyond our control.
Limitation: Our liability is limited to the cost of services provided. We are not responsible for indirect, consequential, or incidental damages.
Maintenance Cooperation: Between service visits, clients should follow provided care instructions and promptly report any concerning changes in aquarium condition.
Electrical and Plumbing: Client is responsible for providing adequate electrical supply and plumbing access as needed for aquarium operation.
Environmental Conditions: Maintain stable room temperature and lighting conditions. Protect aquarium from extreme temperature fluctuations and direct sunlight.
Notification: Immediately notify us of equipment failures, leaks, or livestock health issues. Delays in reporting may affect warranty coverage.
Payment Responsibility: Ensure timely payment according to agreed terms to maintain uninterrupted service coverage.
Project Cancellation: Installation projects may be cancelled with written notice. Deposits are refundable if cancelled before work begins, minus any design fees incurred.
Maintenance Plan Cancellation: Maintenance plans require 30 days written notice for cancellation. No refunds for services already provided or prepaid annual plans.
Service Termination: We reserve the right to terminate services for non-payment, unsafe working conditions, or client behavior that endangers our personnel.
Equipment Removal: Upon service termination, equipment remains property of client unless otherwise specified in service agreement. We provide transition support where possible.
Property Damage: Our liability for property damage is limited to our insurance coverage. We maintain comprehensive general liability insurance for your protection.
Livestock Mortality: While we take every precaution, we cannot guarantee livestock survival due to factors beyond our control including shipping stress, genetic defects, or environmental changes.
Force Majeure: We are not liable for delays or failures due to circumstances beyond our control including natural disasters, power outages, supplier issues, or government restrictions.
Maximum Liability: In no event shall our total liability exceed the amount paid for services during the 12 months preceding the claim.
Information Collection: We collect contact information, service preferences, and payment details necessary to provide our services. We do not sell or share personal information with third parties.
Service Records: We maintain records of services provided, aquarium parameters, and maintenance history to ensure optimal care and service continuity.
Photography: We may photograph completed installations for marketing purposes with client consent. Client may opt out of marketing use at any time.
Data Security: We employ reasonable security measures to protect client information and comply with applicable privacy regulations.
Communication First: We encourage open communication to resolve any concerns promptly. Most issues can be resolved through direct discussion with our service team.
Formal Complaints: Written complaints should be submitted within 30 days of the service date. We will investigate and respond within 10 business days.
Mediation: If direct resolution is not achieved, disputes may be submitted to binding arbitration through a mutually agreed upon arbitrator.
Governing Law: These Terms are governed by local state laws. Any legal proceedings must be initiated within one year of the disputed service.
